منظور از آلود ساختن محیط‌زیست عبارتست از پخش یا آمیختن مواد خارجی به آب، هوا و خاک یا زمین به میزانی که کیفیت فیزیکی، شیمیایی یا بیولوژیکی آن را به‌طوری‌که زیان‌آور به حال انسان یا سایر موجودات زنده یا گیاهان و یا آثار و ابنیه باشد. موضوع حمایت از محیط‌زیست در جهت منافع بشري و از بین بردن آثار مخرب فعالیت‌های صنعتی تبدیل به مسأله اي جدي در جهان معاصر گردیده است و بشریت را مورد تهدید قرار داده است. براي مقابله با این تهدید نیاز به اقدامی قاطع از طریق اتخاذ تدابیر مناسب دارد. رویه عملی محاکم ایران براساس مسئولیت مبتنی بر تقصیر است و آن چنان‌که شایسته است پاسخگوي این‌همه آلودگی و تخریب و جبران خسارت وارد بر محیط‌زیست نمی‌باشد لذا با توجه به لزوم جبران خسارات وارده بر محیط‌زیست و مسئولیت مدنی ناشی از آن، که از جایگاه ویژه‌ای در علم حقوق برخوردار است. در این پژوهش تلاش بر این است که مبناي این بررسی تأثیر بازدارندگی مجازات تخریب محیط‌زیست بر مرتکبین آن در شهر یاسوج تبیین و تشریح و واکاوي قرارگرفته و مبناي مناسب براي این مسئولیت یافت گردد.
The purpose of pollution of the environment is to distribute or blend foreign materials into water, air and soil or land to a degree that causes its physical, chemical or biological quality to harm human or other living organisms or plants or artifacts. The issue of environmental protection in the direction of human interests and the elimination of destructive effects of industrial activities has become a serious issue in the contemporary world and threatened humanity. To deal with this threat, there is a need to take a decisive action by taking appropriate measures. The practical procedure of the Iranian courts is based on the responsibility of the fault, and as it deserves, it is not responsive to all pollution and destruction and compensation for damages to the environment, so considering the necessity of compensating the environment and the damage to the environment. It is right. In this study, the study attempts to the basis of this study of the impact of deterrence of environmental degradation on its perpetrators in Yasuj city, explaining and explaining and finding the right basis for this responsibility.
