مدل نوین حکمرانی قضایی برای توسعه پایدار: از عدالت پایدار تا عدالت هوشمند، بی‌طرف و فراگیر

ملخص المقالة :
این مقاله به طراحی و تبیین یک مدل نوین حکمرانی قضایی همسو با اصول و اهداف توسعه پایدار سازمان ملل متحد (SDGs) می‌پردازد. نظام‌های قضایی سنتی که عمدتاً به حل اختلافات و اجرای قوانین موجود محدود بوده‌اند، در مواجهه با مسائل نوین مانند پایداری زیست‌محیطی، نابرابری‌های اجتماعی و تحولات فناورانه با چالش‌های جدی روبه‌رو هستند. برای غلبه بر این محدودیت‌ها، پژوهش حاضر چارچوبی جامع بر پایه چهار رکن عدالت پایدار، عدالت هوشمند، عدالت بی‌طرف و عدالت فراگیر ارائه می‌کند. عدالت پایدار بر عدالت بین‌نسلی و تضمین پایداری معیشت و منابع طبیعی تأکید دارد تا تصمیمات قضایی به ثبات بلندمدت کمک کنند. عدالت هوشمند از فناوری‌های نوین مانند دادگاه‌های الکترونیک، کلان‌داده و هوش مصنوعی برای ارتقای کارآمدی، شفافیت و دسترسی بهره می‌گیرد. عدالت بی‌طرف به برابری همه شهروندان در برابر قانون بدون تبعیض و دخالت‌های بیرونی توجه دارد و عدالت فراگیر نیز بر تضمین دسترسی اقشار محروم و گروه‌های آسیب‌پذیر به خدمات حقوقی متمرکز است. یافته‌ها نشان می‌دهد که ادغام این چهار رکن می‌تواند دستگاه قضایی را از نهادی صرفاً حقوقی به نهادی حکمرانی و توسعه‌محور تبدیل کند که قادر است عدالت، برابری و توسعه پایدار اجتماعی را ارتقا دهد. مقاله در پایان پیشنهادهای سیاستی برای اجرای این مدل در سطح ملی ارائه می‌کند و بر اهمیت اراده سیاسی، اصلاحات نهادی و همکاری‌های بین‌المللی در پیشبرد حکمرانی قضایی پایدار تأکید دارد.
